Colorful Illustrations 93°C - Update #3

April 30th, 2008

Sendpoints Books Co.,Ltd. replied to my email with…

We found that the publisher - Great Creativity organization has closed down already after survey, so that we miss the chance to contact. If it is need, we may offer the contact for the personal supplier to you.

We hope you may understand this matter, because we also suffer for the wrong information.

I then sent them an email asking for the contact details for their personal supplier, but I guess the quick response of the first email and then (so far) no reply to the next email is an indication they have decided to ignore me. So I decided to do the only thing I could think of to put a smile on my face. I sent them an invoice for the work they are currently reselling and distributing, not for the illustrations, just for the LCS interviews. :)

Colorful Illustrations 93°C

Doing that made me feel me better, even if it will accomplish nothing. I have spoken to an IP Lawyer and perusing this would cost me several thousand, to pursue the publisher with very little chance of any compensation. Getting stores to stop selling it is inexpensive with a simple letter, but very time consuming. Pirates 1 - LCS 0.

If anyone else would like to make themselves feel better about the whole situation send your invoices or emails of complain - about the sale of the book titled ‘Colorful Illustrations 93°C’ to spbooks@163.com with a Carbon copy to gzsendpoint@hotmail.com. Address them to Sophia Guangzhou or Lin Gengli and keep it polite. You can also call them on Tel: 86 20 89095121, Mobile: 86-139 2519 7703, Skype: sendpoint

To anyone reading this who represents Sendpoints Books, I’m happy to remove your contact information from my blog if you would like to email me to discuss the distribution of the book in question.

Great job! The 10% per day after 30 days is a nice touch.

    :)

1000 quid per day ad infinitum….

    Darren,

I’m a bit late to comment on all of this, but it’s such a shame that you had to experience this.

Having said that, you’d have to agree that the whole story has created quite a storm on the web. So, to look on the bright side, I’m hoping that you’ve picked up some new regulars over at Little Chimp, and gained some good publicity in the past few weeks.

In the process, the artists that you’re so passionate about have probably picked a whole lot of new fans as well. Surely this isn’t a bad thing?

It’s terrible that they did this without your knowledge or permission - but they did it because the content on LCS is so good. A back-handed compliment for you no doubt, but I hope there has been some positives that have come out of this experience for you.

Glad to see you making some progress (though I’m sure it’s frustrating and not enough progress).

(Darren: part of this comment has been removed for further investigation)

    Wishing you luck.

    Hi Darren,

I’m really sorry to hear about all of this. It is something I kind of feared for my own mag, as well as domain name registrations. One of the reasons why I registered as a trademark, to hopefully prevent some problems. I received a letter in April about an Asian company wanting to buy my domain and then resell it… or find ways to annoy me. I’m sure when push comes to shove, I can be faced with some issue that overrides me, out of my control… and most illustrators or writers are liable to face the same situation. It simply sucks.

I know that this is just a start on the web for matters similar to yours… and resolving it is not simple, but rather expensive. And a lot of companies in Asia don’t seem to have financial issues, so it becomes an unfair battle… but I’ve made a post about LSC at my online magazine, and look at some posts back, looks like a lot of people in the community have done the same to raise awareness and hopefully shame the company for doing this. And I think if people unite, and make this known… it will reach the media and maybe something will occur to protect us.
